Details of the Request
Under the FOI Act I would like to request copies of the following information relating to the supply of consultancy services for the inprovement of Theatre Utilisation, Efficiency and Productivity contract award (OJEU Ref: 10/S 51-076002):
- Complete ITT response for the Top 3 scoring bids
- A list of all the bidders who submitted PQQs
- A list of all the bitters who submitted ITTs
- A detailed breakdown of the scoring of each PQQ and ITT against the scoring criteria with justification of the marks/points awarded.

Details of the Response
Thank you for your request to Ashford and St. Peter’s Hospitals NHS Trust regarding Supply of Consultancy Services.
The Trust’s Head of Procurement has replied as follows:

Of the 28 firms which expressed an interest in this tender in March, 15 responded to the preliminary qualification questionnaire (extracts from this concerning the selection and sift criteria are below); and eight were invited to tender. Six tenders were received, and, after presentations, were shortlisted (criteria from Invitation to Tender which were used also shown below); the evaluation panel narrowed the shortlist to two, and after further presentations from the two, concluded their deliberations and the contract was awarded.
PQQ Stage
Company selection
The process for selection is agreed as follows:
- A notice is published in the Official Journal of the European Union (OJEU), meeting the requirements of the Public Contracts Regulations 2006 and the Public Procurement Directive 2004/18/EC.
- PQQs are circulated to everyone who expressed an interest.
- Any clarifications on questions asked within the PQQ, or questions on processes relating to the contract should be sent via email to: [named staff member] by 12: noon on Thursday 25 March 2010 (one week before deadline for receipt of questionnaires). All answers to questions will be communicated to all parties expressing an interest to participate, unless the question concerns information of a commercially sensitive nature.
- Following evaluation of PQQ responses the top scoring candidates will be invited to respond to the Invitation to Tender by the stated return date.
- Following evaluation of tenders and the notification of successful tenderer(s) there will be a ten days “stand-still” period prior to execution of contractual documents.
- All candidates will have the opportunity, on request, to receive feedback on their PQQ. For their tender submission, the debrief follows automatically.
PQQ Evaluation Process
Following receipt of responses to the PQQ a preliminary assessment of all submissions shall be undertaken to determine the following:
- The Public Contracts Regulations 2006 Regulation 23 compliance.
- General compliance with the PQQ requirements (satisfactory completion)
- Organisational Capacity to deliver the service
- Economic and Financial Standing
- Successful track record in a related service
- Technical ability to deliver the service
The scoring method which will be used to evaluate the PQQs is as follows:

In the event of numerous high scoring suppliers, the Trust will select the maximum amount of suppliers (as required by the Public Contracts Regulations 2006) with the highest scores to the second stage of the process.
Eligibility Criteria
- Basic Criteria
The Trust will wish to be satisfied that, within the parameters of regulations 23, 24 and 25 of the Public Contracts Regulations 2006, and PCOVA, each Bidder selected has the appropriate qualities, experience and resources to undertake the Contract.
- Financial Capacity
Bidders will be asked to provide evidence of their economic and financial capacity, including management/audited annual accounts for the last three years.
- Technical Capability
Bidders will be asked to demonstrate that they have sufficient experience to meet the Trust’s minimum standards of ability and technical capacity including relevant experience.
- Failure to comply with requirements
The Trust reserves the right to reject any Bidder that fails to comply fully with the requirements of the selection process set out in this document or that is guilty of a serious misrepresentation in supplying any information requested.
ITT Criteria

We consider that the other information requested is confidential to the Trust and to those organisations which participated in the tender process. It would also be against commercial interests to provide it; and to do so could inhibit the free and frank exchange of views of future evaluation panels involved in deliberations over contract awards and tender selections and PQQ sifts preceding them. This is, therefore, exempt under Section 41 of the Freedom of Information Act 2000. Section 41 explains that:
- Information will be exempt from disclosure if it was obtained by the public authority from another party (including another public authority), and
- the disclosure of the information to the public (otherwise than under this Act) by the public authority holding it would result in a breach of confidence actionable by that or any other party.
