Details of the Response
Thank you for your email of 12 November asking, under the Freedom of Information Act (FOIA), for a range of information concerning this Department’s Information and Communications Technology (ICT).
S12(4)(b) of the FOIA provides that where more than one request is received by a public authority from persons appearing to be acting in concert, that authority is empowered to aggregate such requests for cost purposes. Your request being one of seven received within a very short space of time, addressed to the same team in the Department, but from separate email addresses and claiming to be from separate requestors, for complementary information which if released would form a discrete body of information, we have concluded that the conditions for reliance on s12(4)(b) have been met.
We have estimated that the cost of compliance with this group of requests would be significantly in excess of the £450 or 3.5 person/day limit specified under regulations drawn up in pursuance of s12. We will therefore not be proceeding further with this request.
However, you and your colleagues do have the right to make a new and narrower request with which it might be possible for the Department to comply within the cost limit, although we cannot guarantee that this will be the case, nor that any information so located might not prove to include material exempt in whole or in part from the duty to disclose, under the various provisions of the FOIA.
